Liability and indemnity
We will not be liable for any loss of profit or any indirect, special, or consequential loss, damage, costs or claims related to the provision of the garden waste scheme or the performance of any of our other obligations under these terms and conditions or with the use by the customer(s) of the services supplied whether as a result of breach of contract, breach of statutory duty, tort (including negligence) or otherwise howsoever arising. This includes our:
- employees
- contractors
- agents or otherwise
We will not be liable to customers or in breach of these terms and conditions due to delays or failures in service due to circumstances beyond our reasonable control.
Nothing in these terms and conditions will limit or exclude our liability for death or personal injury caused by our negligence or for any other reason for which it would be unlawful to exclude or limit liability.
