CCTV subject access requests
For CCTV subject access requests, we usually only provide footage of the requester, unless:
- other identifiable individuals have given consent, or
- it is appropriate to release the footage without their consent
All other personal data which may allow the identification of any other person should be:
- hidden, or
- deleted
Third-party data will only be released without third party consent where the council considers it appropriate to do so. This is based on the circumstances of the case.
We will not be able to provide footage if information provided is:
- insufficient, or
- inaccurate
This is because we will not be able to identify the footage.
If it is not appropriate to release third-party data, we will try to hide or delete it to allow disclosure.
If that is not possible, we will:
- provide a description of the CCTV footage and what is shown, or
- make other reasonable efforts
Each request is treated on its own merit.
If you have made a subject access request application, please be aware it is unlikely to succeed. This application can be made under the General Data Protection Regulation.
You should also be aware that CCTV images are only kept for 30 days from the date of the recording. This is so that we keep in line with our retention schedule.
Obtaining camera images for other purposes
We do not provide CCTV footage to individuals for other types of incidents. If footage is required as evidence of a crime, then the police will contact us directly.
Legal information
Please note that the footage is provided pursuant to Schedule 2 Part 1 Paragraph 5 of the Data Protection Act 2018, where personal data is exempt from the non-disclosure provisions where disclosure is necessary.
