Preparation for the hearing
Preparation of your case is very important. You may wish to seek help from:
- a solicitor
- the Citizens Advice Bureau
When making your case in Court you should have good evidence upon which the Court can rely. This will generally be facts or events you have experienced.
The most effective way to prepare your case is to keep a record of the incidents that have caused a nuisance to you, including:
- the date
- time and place that you were affected
- the duration of the disturbance
- how you were affected
This will help you when you are in court when questioned.
Do not state events which someone else reported to you unless that person also gives evidence to confirm this. This is called 'hearsay evidence' and will not be accepted.
It is helpful if more than one person records the nuisance and that the willingness and availability of such persons to attend Court is known (time off work, holidays etc.).
