Both the complainant and the occupier/owner of the neighbouring land can appeal.
Grounds for Appeal
The recipient can appeal the decision on the following grounds:
- height is not adversely affecting amenity
- remedial and/or preventative action is excessive
- compliance period too short
The complainant can appeal on:
- remedial and/or preventative action is insufficient
Offence
Failure to comply with the requirement of a notice within the compliance period, or to comply with any preventative action within the period stated, by any owner or occupier, is a summary offence punishable with a fine of up to £1000.
